These Terms of Service ("Terms") form a legally binding agreement between you ("User," "you," or "your") and Open Line Club LLC governing your access to and use of the Open Line platform—including websites, mobile applications, APIs, messaging systems, and related services operated by Open Line or by third-party operators using Open Line's technology (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, and all policies referenced herein. If you do not agree, do not use the Service.
Open Line operates a platform that may be made available through websites branded and operated by third-party agencies or partners ("Operators"). Regardless of which Operator's branded site you access, Open Line Club LLC is the platform provider responsible for the technology, infrastructure, compliance systems, payment processing, content moderation, and the policies governing the Service.
1. Eligibility
You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old, that the information you provide is accurate and complete, and that your use of the Service complies with all applicable laws.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify Open Line immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or are involved in fraudulent, illegal, or harmful activity.
Creators must complete identity verification (KYC) and provide tax information through Open Line's verification systems before uploading content or receiving payouts.
3. The Service
Open Line is a platform connecting creators and fans through digital content, messaging, subscriptions, tips, and other interactive features.
3.1 Subscriptions & Digital Content
Fans may purchase subscriptions, pay-per-view content, messages, tips, and other digital goods and services. All pricing is set by individual creators and displayed on their profiles. All transactions processed through the Service are for digital content and services only.
3.2 Tangible Goods Prohibition
Creators may not offer tangible or physical goods for sale on the Service. All transactions are limited to digital content and services. Any attempt to sell, advertise, or fulfill physical merchandise or tangible goods is prohibited and may result in content removal and account suspension.
3.3 Video Calls
Open Line may offer a Video Calls feature allowing fans to schedule and conduct live video sessions with creators.
- Pricing: Set by individual creators and displayed on their profile. Not included in subscription pricing unless a creator explicitly states otherwise. Billed per session at booking.
- Moderation: All sessions are subject to these Terms and content policies. Open Line employs automated monitoring and reserves the right to review session recordings or metadata for compliance and safety.
- Prohibited Conduct: No illegal activity, no minors, no content standard violations. Violations result in immediate session termination and may result in account suspension or permanent termination.
3.4 Communications & Authorized Representatives
You acknowledge and agree that messages, replies, and other communications sent from a creator's account may be authored or sent by the creator personally or by one or more authorized representatives, including agency staff, managers, assistants, or other personnel permitted by the creator and the applicable Operator to assist with account communications. Open Line does not warrant, and creators do not warrant, that any specific communication originates from the creator personally unless expressly stated. Communications are provided as an entertainment and engagement service and are not represented as a guarantee of personal authorship by the creator.
By purchasing subscriptions, messages, tips, pay-per-view content, video calls, or any other product or service on the Service, you expressly waive any claim, refund right, or payment-card chargeback based solely on the assertion that a communication was sent by an authorized representative rather than the creator personally. Chargebacks filed on this basis will be disputed by Open Line as a breach of these Terms, and Open Line may suspend or terminate accounts that initiate such chargebacks.
4. Content Standards & Prohibited Content
The following content is strictly prohibited:
- Content illegal under any applicable law.
- Child sexual abuse material (CSAM) or content depicting minors in a sexual or exploitative context.
- Non-consensual intimate imagery (NCII).
- Content depicting, promoting, or facilitating human trafficking, forced labor, or sexual exploitation.
- Content promoting terrorism, inciting violence, or glorifying self-harm.
- Intellectual property infringement.
- Hate speech, harassment, threats, or discrimination.
- Spam, deception, impersonation, or fraud.
- Content violating payment processing partner standards.
- Protected health information ("PHI") as defined under the Health Insurance Portability and Accountability Act ("HIPAA"), individually identifiable health information, medical records, treatment information, or any other data subject to HIPAA, the HITECH Act, or comparable health privacy laws in any jurisdiction.
- Payment card data subject to PCI-DSS (full card numbers, CVV/CVC, magnetic stripe, or PIN data) transmitted outside of the Service's designated payment flows.
- Other regulated data including, without limitation, government identification numbers (Social Security numbers, passport numbers, driver's license numbers other than as required for KYC), financial account credentials, biometric identifiers, children's personal information subject to COPPA, or data subject to GLBA, FERPA, or similar regulatory regimes.
The Service is a general-purpose messaging and content platform. It is not designed, intended, or certified for the transmission, storage, or processing of PHI or other regulated data. Open Line is not a HIPAA "Covered Entity" or "Business Associate" and will not enter into a Business Associate Agreement. You are solely responsible for any regulatory consequences arising from your transmission of regulated data through the Service.
We reserve the right to remove content and suspend or terminate accounts at our discretion.
5. Content Review & Pre-Screening
All content uploaded by creators or users is subject to review before publication. Open Line employs automated moderation tools and human review to screen for compliance with these Terms, applicable law, and payment processor content policies.
Content is evaluated for:
- Legal compliance, including laws on obscenity, CSAM, NCII, and trafficking.
- Verification that all depicted persons are 18+ with valid, documented consent.
- Community Standards and payment processor policy compliance.
Rejected content will not be published. Repeated violations may result in account suspension or termination. Previously published content may be removed if later found to be in violation.
6. Creator / Content Provider Agreement
Any user who uploads or generates content ("Creator" or "Content Provider"), including live-streamed content, must agree to the Open Line Creator Agreement during registration. The Creator Agreement is accepted by checking a separate, dedicated checkbox and requires each Creator to:
- Confirm they are at least 18 and complete identity verification (KYC).
- Agree to all content standards and prohibited content rules.
- Obtain and retain written consent from all depicted persons: consent to depiction, public distribution, and downloading (if applicable).
- Verify the identity and age (18+) of all depicted persons via government-issued photo ID.
- Retain consent and age verification records for a minimum of 7 years after content removal.
- Provide records to Open Line upon request within 48 hours.
- Not share account credentials with, or otherwise permit, any third party to access or operate the creator's account, except through Operator-onboarded staff accounts whose users have separately registered, completed identity verification, and accepted these Terms and the Creator Agreement. Credential sharing, unauthorized delegation, and use of unvetted third-party chatters, ghostwriters, or messaging services are a material breach. The creator remains fully responsible for all activity on the account, including chargebacks, refunds, processor penalties, and content violations arising from any third party operating the account, whether or not authorized.

7. Creator Image & Likeness Consent
During registration, each Creator must provide explicit consent for Open Line to use and display their images, likeness, voice, and uploaded content. This consent is collected through a separate, clearly distinct checkbox, independent from the Terms of Service and the Creator Agreement:
"I acknowledge and agree that my images, likeness, voice, and any content I upload will be used and displayed publicly on the Open Line platform, including for promotional and marketing purposes. I understand that this content may be viewed, shared, and accessed by other users. I grant Open Line Club LLC a non-exclusive, worldwide, royalty-free license to display, distribute, reproduce, and promote my content and likeness on and in connection with the Service. I may revoke this consent at any time by contacting creators@openline.club, subject to the Creator Agreement."
Creators must affirmatively check this box before uploading content. The system logs the timestamp, IP address, and account ID when consent is given.
8. Payments, Fees & Payouts
Payments are processed through CCBill and/or Stripe. Open Line does not store full credit card or bank account numbers. By purchasing, you agree to the payment processor's terms.
Creator payouts are subject to Open Line's commission structure, minimums, schedules, and tax withholding as detailed in the Creator Agreement and Creator Dashboard.
Open Line may withhold, suspend, offset, recoup, or forfeit creator payouts in cases of fraud, chargebacks, refunds, processor fines or penalties, Terms violations, or pending investigations. Creators are financially responsible for chargebacks, refunds, and processor penalties arising from communications, content, or activity sent or conducted by the creator or by any third party operating the creator's account, whether or not such third party was authorized by Open Line. Open Line may deduct these amounts from current or future payouts, and where amounts owed exceed available payouts, Open Line may invoice the creator directly for the balance, which is due within thirty (30) days. Creators who repeatedly incur chargebacks or who exceed payment-processor chargeback thresholds may have payouts suspended or accounts terminated.
9. Intellectual Property
Creators retain ownership of their content, subject to the license granted in Section 7 and the Creator Agreement. The Open Line name, logo, trademarks, and proprietary technology are the exclusive property of Open Line Club LLC.

10. Complaints & Content Removal Policy
This policy applies to all content on the Service and is accessible from every page where content appears.
10.1 Reporting Content
Report content that is illegal, violates these Terms, or violates payment processor policies:
- In-platform reporting feature (flag icon on any content).
- Email complaints@openline.club with the URL, description, and your contact info.

10.2 Acknowledgment & Timeline
Complaints acknowledged within one (1) business day. Reviewed and resolved within five (5) business days. Complainant notified if additional time is needed.
10.3 Review Process
Upon receipt:
- Logged and assigned to a trained reviewer.
- Content reviewed against laws, Terms, and payment processor policies.
- Content may be temporarily restricted pending review.
- Content uploader notified (unless doing so would compromise an investigation or endanger any person).
10.4 Potential Outcomes
- No action (content compliant).
- Content removed or access disabled.
- Warning issued.
- Account suspended or terminated.
- Reported to law enforcement (suspected illegal activity, exploitation, or CSAM).
10.5 Appeals
Either party may appeal by emailing appeals@openline.club within fourteen (14) calendar days. Appeals reviewed by a senior compliance team member not involved in the original decision, resolved within five (5) business days. Unresolved disputes may be referred to an independent, neutral third-party arbitrator.
11. Depicted Persons — Right to Request Content Removal
Any individual depicted in content on the Service may request removal at any time, regardless of registration status.
11.1 Removal Requests
Email takedown@openline.club with: (a) full legal name; (b) URL or description of content; (c) statement you are depicted; (d) government-issued photo ID (used for verification only, then deleted); (e) basis for request.
11.2 Review
Reviewed within five (5) business days. Content may be restricted during review. If consent was not obtained, revoked, or void under law, content is permanently removed.
11.3 Appeals & Neutral Resolution
Either party may appeal via appeals@openline.club within fourteen (14) days. Unresolved disputes referred to an independent, neutral arbitration body. Open Line will comply with the neutral body's decision.
12. Anti-Human Trafficking Policy
Open Line Club LLC has zero tolerance for human trafficking, forced labor, sexual exploitation, or coercion.
12.1 Prohibited Conduct
- Content depicting, promoting, or facilitating trafficking, forced labor, or exploitation.
- Recruitment, harboring, or obtaining persons through force, fraud, or coercion.
- Content or activity involving minors in sexual or exploitative contexts.
- Conduct violating the TVPA (18 U.S.C. §1591) or other anti-trafficking law.
12.2 Prevention & Detection
- All creators complete KYC before uploading content.
- All content pre-screened and monitored for trafficking indicators.
- Moderation teams trained on trafficking, coercion, and exploitation indicators.
- Full cooperation with law enforcement; reporting to NHTH (1-888-373-7888).
- Creator identity verification and consent records maintained.
12.3 Reporting
Report to legal@openline.club, or call the National Human Trafficking Hotline at 1-888-373-7888, or text "HELP" to 233733 (BeFree). Violations result in immediate termination and law enforcement referral.
13. Termination
Open Line may suspend or terminate your account at any time. You may delete your account through settings. Surviving provisions: IP, indemnification, limitation of liability, dispute resolution.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. OPEN LINE DOES NOT WARRANT THAT THE SERVICE OR ANY OF ITS FUNCTIONS WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE, ITS SERVERS, OR ANY EMAIL OR FILES SENT THROUGH THE SERVICE ARE FREE OF VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS. OPEN LINE STRIVES TO LIMIT THE FREQUENCY AND DURATION OF ANY SUSPENSION OR RESTRICTION OF ACCESS (INCLUDING FOR REPAIRS, MAINTENANCE, OR UPDATES) BUT MAKES NO GUARANTEE OF AVAILABILITY.
14.1 No Guarantee of Creator Success
Open Line makes no representations, warranties, or guarantees regarding any creator's commercial success on the Service. Without limiting the foregoing, Open Line does not guarantee, and shall not be responsible for: (a) any level of earnings, revenue, payouts, or profits a creator may receive; (b) the number, growth, retention, engagement, or behavior of fans, subscribers, or viewers; (c) the visibility, reach, ranking, or discoverability of any creator or content; (d) the continued availability of any feature, monetization mechanism, or pricing model; or (e) the outcome of any individual interaction, message, subscription, tip, or transaction. Earnings depend on numerous factors outside Open Line's control, including the creator's content, conduct, marketing, and audience. Any statements regarding potential earnings are illustrative only and are not promises or guarantees. Any testimonials, case studies, or success stories published by Open Line or its Operators are independent and genuine, but they do not represent a guarantee or warranty of similar results, and your individual results will differ. Failure to use the Service consistently or in accordance with these Terms and any published best practices may diminish your results.
14.2 No Liability for User Communications
Open Line provides messaging and communication features as a neutral conduit between users and creators. Open Line does not originate, endorse, monitor in real time, or vouch for the accuracy, legality, or appropriateness of any message, content, image, video, voice note, or other communication transmitted between users through the Service. You acknowledge that all communications are sent at your own risk and that Open Line is not responsible for the content of any communication, including any communication that violates HIPAA, PCI-DSS, GDPR, CCPA, defamation laws, intellectual property laws, or any other applicable law or regulation.
14.3 Not a Regulated Service
The Service is not a healthcare service, medical device, financial advisor, legal advisor, or other regulated professional service. Communications on the Service do not constitute medical, legal, financial, or professional advice. Open Line is not a HIPAA Covered Entity or Business Associate and the Service is not HIPAA-compliant.
14.4 Third-Party Links, Products, and Services
The Service may contain links to, or allow creators and users to share links to, third-party websites, products, or services that are not owned or controlled by Open Line. Any such third-party site, product, or service is subject to its own separate terms and conditions and privacy policies. Open Line is not responsible or liable for the content, accuracy, availability, security, or practices of any third-party site, product, or service, or for any actions taken by any third-party operator. Although Open Line or a creator may recommend or reference a third party, it is your sole responsibility to investigate and evaluate any third party before entering into any transaction or relationship with them. Your dealings with any third party are solely between you and that third party.
14.5 Data Transmission Risk
Security of personally identifiable information is important to Open Line, and we implement administrative, technical, and physical safeguards designed to protect it. However, no method of transmission over the internet and no method of electronic storage is, or can be guaranteed to be, 100% secure. While Open Line strives to protect your personal information, we cannot ensure or warrant the security of any information you transmit to or through the Service. By transmitting any information to Open Line or through the Service, you accept that you do so at your own risk.
14.6 Geographic Scope
Open Line controls and operates the Service from offices in the United States. Open Line makes no representation that the Service or any Content is appropriate, lawful, or available for use in any particular location. Users who choose to access the Service from outside the United States do so on their own initiative and are solely responsible for compliance with all applicable local laws, including laws governing online content, adult content, age verification, consumer protection, taxation, export controls, and data protection. You may not access or use the Service from any jurisdiction in which doing so would be unlawful or in which Open Line is prohibited from offering the Service.
15. Limitation of Liability
OPEN LINE'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID IN THE PRECEDING 12 MONTHS, OR (B) $100. NO INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
16. Indemnification
You agree to defend, indemnify, and hold harmless Open Line Club LLC, its parents, subsidiaries, affiliates, Operators, officers, directors, employees, contractors, agents, licensors, and service providers from and against any and all claims, demands, actions, investigations, liabilities, damages, losses, judgments, fines, penalties, costs, and expenses (including reasonable attorneys' fees and costs) arising out of or related to:
- (a) your use of, access to, or activity on the Service;
- (b) any content, message, image, video, voice note, link, or other communication you upload, transmit, send, receive, store, or display through the Service, including any communication exchanged between a creator and a fan;
- (c) any transmission, disclosure, storage, or processing by you of protected health information ("PHI"), payment card data, government identifiers, biometric data, children's data, or any other regulated data through the Service, including any resulting claim, investigation, or penalty under HIPAA, the HITECH Act, PCI-DSS, GLBA, COPPA, FERPA, GDPR, CCPA/CPRA, or any other privacy, data protection, consumer protection, or health information law in any jurisdiction;
- (d) your violation of these Terms, the Creator Agreement, our Privacy Policy, our Community Standards, or any other policy referenced herein;
- (e) your violation of any applicable law, rule, or regulation, or the rights of any third party, including rights of privacy, publicity, intellectual property, or contract;
- (f) any dispute between you and any other user, creator, fan, Operator, or third party arising from communications, transactions, or interactions on or through the Service; and
- (g) any tax, withholding, reporting, or filing obligation arising from your activity on the Service.
Open Line reserves the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Open Line in asserting any available defenses. This indemnification obligation will survive termination of these Terms and your use of the Service.
17. Dispute Resolution
Binding arbitration via JAMS in Los Angeles, California. Jury trial and class action waived. Governed by California law.
18. General Provisions
Severability, no waiver, entire agreement, no assignment without consent.
19. Changes to These Terms
We may update these Terms. Material changes receive additional notice. Continued use constitutes acceptance.
